1. About Fetchly

Fetchly acts solely as a sourcing service. We do not sell products or handle transactions between buyers and suppliers. All purchases are made directly between the buyer and the supplier.

By accessing and using the Fetchly platform (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms & Conditions apply to all users of the Service, including but not limited to browsers, customers, and contributors of content.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Fetchly's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modifying or copying the materials
• Using the materials for any commercial purpose or for any public display
• Attempting to decompile or reverse engineer any software contained on the Service
• Removing any copyright or other proprietary notations from the materials
• Transferring the materials to another person or "mirroring" the materials on any other server

Fetchly does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations of Liability

In no event shall Fetchly or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Fetchly's website, even if Fetchly or an authorized representative has been notified orally or in writing of the possibility of such damage.

Fetchly is not responsible for:

• Products not arriving or arriving damaged
• Quality of products sourced by third-party suppliers
• Disputes between users and suppliers
• Customs delays or import/export issues
• Service interruptions or technical issues beyond our control
• Shipping arrangements or delivery times
• VAT, customs duties, or import taxes

All purchases are made directly between you and the supplier. Fetchly acts only as a sourcing intermediary and does not handle product transactions, shipping, or payment processing between parties.

5. Accuracy of Materials

The materials appearing on Fetchly's website could include technical, typographical, or photographic errors. Fetchly does not warrant that any of the materials on its website are accurate, complete, or current. Fetchly may make changes to the materials contained on its website at any time without notice.

6. Materials & Content

The materials on Fetchly's website are protected by copyright law and international treaties. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute the materials in any way without Fetchly's prior written permission.

Unauthorized use of the materials contained on Fetchly's website may violate copyright, trademark, and other laws. You grant Fetchly a worldwide, non-exclusive, royalty-free license to use any content you submit.

7. Limitations on Use

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. Prohibited behavior includes:

• Harassing or causing distress or inconvenience to any person
• Transmitting obscene or offensive content
• Disrupting the normal flow of dialogue within our website
• Attempting to gain unauthorized access to our systems

8. Payment & Pricing

All prices are displayed in EUR (€). Our pricing model is transparent and consists of two parts:

• Request Fee: €5 (Standard), €10 (Express), €20 (Urgent) — paid upfront to submit your sourcing request
• Sourcing Fee: Only charged if you accept the sourcing result — amount varies based on request complexity

Your budget is used as a reference for sourcing and negotiation. This is NOT the amount you will pay on this platform.

Payments are processed securely through Stripe. By submitting payment, you authorize Fetchly to charge your payment method.

9. Refund Policy

• Request Fee: Non-refundable. The request fee covers our sourcing work and research effort.
• Sourcing Fee: Only charged if you accept a sourcing result. If you decline the offer, no sourcing fee is charged.
• Refund Requests: Must be submitted within 30 days of payment
• Processing Time: Refunds are processed within 5-10 business days

Important: Fetchly is not responsible for product quality, delivery, or supplier-related issues. These are handled directly between you and the supplier.

10. Sourcing Service Disclaimer

IMPORTANT: Fetchly acts solely as a sourcing service and does not sell products directly. We do not process product transactions, handle payments between parties, or take possession of products. All purchases are made directly between you and the supplier.

• Not a Marketplace: Fetchly is not a marketplace or e-commerce platform. We do not list products for sale.
• Sourcing Service Only: We help you find suppliers and negotiate terms. The actual purchase is between you and the supplier.
• Product Quality: Fetchly is not responsible for product quality, specifications, or condition. This is the responsibility of the supplier.
• Delivery & Shipping: Fetchly is not responsible for shipping delays, delivery failures, or shipping costs. These are handled by the supplier.
• Customs & Taxes: You are responsible for any customs duties, VAT, import taxes, or other government fees.
• Supplier Disputes: Any disputes with suppliers should be resolved directly with the supplier, not with Fetchly.
• Payment Processing: Fetchly only processes payment for our sourcing fee. Product payments are made directly to the supplier.

11. User Accounts & Verification

To use certain features of the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Email verification is required to submit product requests. You agree to verify your email address and maintain an active, verified account to use the Service.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

11. Intellectual Property Rights

All content on the Fetchly website, including but not limited to text, graphics, logos, images, and software, is the property of Fetchly or its content suppliers and is protected by international copyright laws.

The Fetchly name and logo are trademarks of Fetchly. You may not use these trademarks without our prior written permission.

12. User-Generated Content

You retain ownership of any content you submit to Fetchly (product descriptions, images, messages). By submitting content, you grant Fetchly a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

You represent and warrant that you own or have the necessary rights to all content you submit and that such content does not violate any third-party rights or applicable laws.

13. Termination & Account Suspension

Fetchly reserves the right to terminate or suspend your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Violation of these Terms & Conditions
• Fraudulent or suspicious activity
• Non-payment or payment disputes
• Abuse of the Service or other users
• Submission of illegal or prohibited content

Upon termination, your right to use the Service immediately ceases.

14. Indemnification

You agree to indemnify, defend, and hold harmless Fetchly and its officers, directors, employees, and agents from any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms & Conditions, or your violation of any rights of another.

15. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of Germany, and you irrevocably submit to the exclusive jurisdiction of the courts located in Germany.

16. Dispute Resolution

Any dispute arising out of or relating to these Terms & Conditions or the Service shall first be addressed through good-faith negotiation between the parties. If the dispute cannot be resolved within 30 days, either party may pursue legal action in accordance with the governing law section above.

17. Modifications to Terms

Fetchly may revise these Terms & Conditions at any time without notice. By continuing to use the Service after such modifications, you agree to be bound by the revised Terms & Conditions.

18. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
